PFAS regulation alignment

PFAS restrictions are becoming a major issue for surface treatment, plating and specialty chemicals. As various authorities are looking at how to lessen the impact of “forever chemicals” and to make certain that the use is safe, the EBC would like to highlight the need for greater alignment between the EU and Japan. Differences in definitions, regulatory approaches, restrictions, exemptions and assessment requirements could increase compliance costs and create unnecessary barriers for companies operating across both markets. At the same time, regulatory measures should take into account the different functions and applications of PFAS, as well as the availability and suitability of alternatives.
Recommendations
- EU-Japan cooperation and mutual recognition of assessment schemes are of utmost importance moving forward. Greater regulatory alignment, including where possible common approaches to definitions, risk assessment, exemptions and reporting requirements, would help avoid unnecessary duplication and facilitate trade while maintaining a high level of environmental and human health protection.
- The EBC encourages the Japanese authorities to take into account relevant EU regulatory developments and international scientific assessments when developing future PFAS measures, and to maintain dialogue with industry to ensure that restrictions are proportionate, risk-based and consider the availability of technically suitable alternatives.
